Terms of Service

These terms are an agreement between you and Mersudin Forbes (“we”, “us”), the operator of the Know. app and this website. By creating an account or using Know., you accept these terms. If you do not accept them, please do not use the app.

1. What Know. is

Know. is a family circles app: members of a circle share profile details such as birthdays, clothing/shoe/ring sizes, interests and wish lists; can claim gifts from each other's wish lists (with claims hidden from the list's owner); and share a family calendar, tasks, and gift suggestions. Parents and guardians can also create and manage profiles for children in their care.

2. Accounts

• You must be at least 16 years old to create an account. Children do not have accounts; kid profiles are records created and controlled by a parent or guardian's account.
• You are responsible for keeping your sign-in credentials secure and for activity that happens under your account. Tell us promptly at mersudin@mersudinforbes.com if you believe your account has been compromised.
• You must provide accurate account information and keep it up to date.

3. Your content

• You keep ownership of everything you enter into Know., including your profiles, wish lists, family records, events and tasks (“your content”).
• You grant us the limited licence needed to operate the service: to store your content, sync it between your devices, and display it to the circle members and people you choose to share it with. We claim no other rights over it.
• You are responsible for your content, including content you enter about others. When you create a profile or record for another person, especially a child, you confirm that you are entitled to do so (for example, as their parent or guardian) and that the information is accurate to the best of your knowledge.
• You can edit or delete your content at any time in the app; deleting your account removes your data, as described in our Privacy Policy.

4. Acceptable use

You agree not to:

• use Know. for anything unlawful, or to harass, deceive, impersonate or harm anyone;
• enter information about a person you have no right to record, including creating a kid profile for a child who is not in your care without the guardian's agreement;
• attempt to access other users' data outside the sharing rules of the app, or to probe, disrupt or reverse-engineer the service or its security measures;
• use the service to send spam or unwanted invitations, or misuse invite links or codes;
• resell or commercially exploit the service without our written agreement.

We may suspend or remove content or accounts that breach these terms.

5. Gift links and affiliate disclosure

The Gift Advisor suggests gifts and can open product pages on Amazon. These links use an Amazon affiliate tag: as an Amazon Associate, we may earn a small commission on qualifying purchases, at no extra cost to you. This is also disclosed in the app. Purchases are made with Amazon, not with us: Amazon's own terms and privacy policy apply to anything you do on their site, and we are not a party to, and have no responsibility for, any purchase, price, delivery, product or dispute between you and Amazon or any other retailer. Gift suggestions are ideas, not recommendations that a product is suitable, safe or accurately described.

6. Availability and changes to the service

Know. is provided as a consumer app and we work to keep it running well, but we do not promise uninterrupted or error-free operation. We may add, change or remove features, and we may update these terms; if we make significant changes we will tell you in the app or by email, and the “Last updated” date above will change. Your continued use after a change means you accept the updated terms; if you don't, you may stop using the app and delete your account at any time.

7. Disclaimer and limitation of liability

Except as expressly set out in these terms, the service is provided “as is” and we make no other warranties or guarantees about it, to the extent the law allows us to say so.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of England and Wales. If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.

Subject to the paragraph above: we are not liable for losses that were not foreseeable to both of us when you accepted these terms, losses caused by your breach of these terms, business losses (Know. is for personal, family use), or losses arising from your dealings with third parties such as Amazon. Where we are liable to you and the law allows liability to be limited, our total liability in connection with the service is limited to £100 (or, if greater, the amount you have paid us for the service in the 12 months before the claim arose).

8. Termination

You can stop using Know. and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if we discontinue the service, in which case we will give you reasonable notice where we can. Sections that by their nature should survive termination (such as sections 5, 7 and 9) do so.

9. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, except that if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and consumers always retain the protection of mandatory rules of the law of the country they live in.
